PRIVACY NOTICE 

Le Management ApS and Le Management Kids (hereinafter referred to as “LM”, “we” or “us”) are committed to protecting the privacy and security when processing your personal data. This Privacy Notice describes how we collect and use your personal data.  

This Privacy Notice is intended for any former, current or potential model or talent represented by LM (“Talents”) as well as clients, suppliers or just any visitor to the website. And, where applicable, parents or guardians of any Talents we represent. 

It is important that you read this Privacy Notice so you are aware of how and why we are using your data and what your rights are under the relevant data protection legislation. 

1. DATA CONTROLLER 
LM is responsible for the processing of personal data we have obtained from you or about you and making sure it’s processed in accordance with the data protection legislation. In accordance with the applicable regulations on the protection of personal data, LM is the “data controller”.

1.1 Contact

You are welcome to contact us using one of the following languages: Danish, English, Norwegian, Swedish, or German.  

We will respond to your inquiry as quickly as possible. We strive to answer all inquiries as quickly as possible and no later than within 1 month. 

We request that, in connection with inquiries regarding your rights as described in section 6, you provide us with sufficient information to process your inquiry, including your full name and email address, so that we can identify you and respond to your inquiry. 

  

2. LM AS DATA PROCESSOR 

In certain cases, LM acts as a data processor on behalf of third parties. In cases where LM is the data processor, LM acts according to the instructions of the data controller and in accordance with a data processing agreement. In these cases, this privacy policy does not apply to the processing. 

3. INFORMATION COLLECTED, THE PURPOSE OF DATA PROCESSING AND THE LEGAL BASIS 

We collect personal data directly provided by you or made public by you. This may include publicly available information, including data we obtain from commonly accessible sources. Furthermore, we also receive technical data from analytical third-party providers, regarding your visit to our website. 

We process personal information about you in a variety of different situations. Please read below for further details on our processing in these various situations. 

3.1 Visitors to our website 

When you visit our website, we may process information about your IP address as well as information about your computer, device, and browser. We may also process information about your visit (e.g., information about how you accessed our website, how you navigate it, which pages you visit, content you view, your searches, advertisements you have seen, etc.). This information is collected through cookies, log files, google analytics and other technologies. 

We may also process data that you provide to us in connection with your use of the website, such as when you fill out a form or register online, including your (company) name, (company) address, (work) phone number, (work) email address, title, and any other information you provide to us. 

We use the information to make relevant services available to you and to improve your experience of our websites and online services, as well as the services we offer. We also use data to show you content on our and others’ pages based on your activities and preferences, and to limit the number of times you see the same content. 

Failure to provide the requested information may impact the functionality of our website for you.

Our legal basis for processing is our legitimate interests, cf. GDPR Article 6.1.f or your consent, cf. GDPR Article 6.1.a. 

3.2 Newsletters 

We use personal data for marketing purposes, hereinunder to target it specifically for the individual person. This includes sending newsletters and presenting relevant marketing to you on our website as well as other websites and social media. 

You will be able to receive newsletters from us if you are an existing Talent or client of LM.  

When you receive marketing material from us, we process information such as your name, (work-)phone number and (work-)email address. We also process information about your preferences regarding marketing or communication, as well as your use of the marketing materials we send to you and any other information you provide to us. 

We process your information for the purpose of marketing our company and its services, creating and managing your subscription to marketing materials. We use the information about your preferences and behavior to understand how individuals receive our marketing materials and to improve future marketing efforts. 

We only send marketing material to you via email when we have obtained your consent to do so.  

When you subscribe to our newsletter, you give us consent to process your personal information, cf. GDPR Article 6.1.a and the Danish Marketing Act § 10, solely for the purpose of receiving newsletters and marketing materials. You can withdraw your consent at any time by unsubscribing from the newsletter, cf. GDPR Article 7.3, which can be done by clicking the “Unsubscribe” link at the bottom of the newsletter. Your information will then be deleted unless we have another legal basis that allows us to continue processing the personal information. 

We also use data about you to show you content on our and others’ pages based on your activities and preferences, and to limit the number of times you see the same content, as well as to measure the effectiveness of our content and marketing efforts. 

If you choose not to provide the requested information, it may limit your ability to receive personalized content and updates through our newsletters and other marketing materials. 

Our legal basis for processing is our legitimate interests, cf. GDPR Article 6.1.f and/or your consent, cf. GDPR Article 6.1.a and the Danish Marketing Act § 10.  

3.3 Clients and client prospects 

When you are a client/potential client of ours or a contact person at one of our clients/potential clients, we process personal information such as your (company) name, (company) address, (work) phone number, (work) email address, title, payment information, as well as information from publicly available sources and any other information you provide to us. 

We process personal information for the purpose of fulfilling the agreement with our clients, including delivering services, invoicing, conducting statistics and quality management, as well as maintaining our client records and providing general service, marketing, and sales to our clients and potential clients. 

Due to the purpose of the individual agreement, it is therefore a requirement that the client provides the personal data specified above. If the client does not wish to provide this information, an agreement may not or may only partially be finalized, and it may not be possible to provide our services. 

Our legal basis for processing is the agreement with you, cf. GDPR Article 6.1.b and/or our legitimate interests, cf. Article 6.1.f. 

3.4 Talents 

3.4.1 Scouting  

If you have been scouted, attended a casting or open-call, or submitted an application to become a talent or similar, we collect the personal data you have directly provided to us. This may include your name, email address, phone number, date of birth, height, body measurements, gender, social media handles, photographs, and nationality. We process this information in order to assess and evaluate your profile and determine whether we wish to offer you representation. 

Our basis for processing this information is your consent to the processing of the personal data, cf. GDPR Article 6.1.a and/or our legitimate interest in identifying potential models to maintain our talent pool, cf. GDPR article 6.1.f. 

 
 
3.4.2 Representation 

If you are selected to join our talent pool, LM will process your personal data to establish, manage, and fulfill the relationship with you, and for compliance with all related obligations deriving from the applicable law. We collect personal data either directly from you, from publicly available sources, or from third parties such as partner agencies acting on a customary power of attorney 

We collect and process general personal data, including identity/company data such as your full legal name and/or company name, date of birth, nationality, gender, personal identification number, and copies of identification documents (e.g., driver’s license, passport, or birth certificate). We also collect contact details, including your email address, phone number, address, and information on next of kin or emergency contacts. In addition, we process financial data such as bank account details, payment transactions, VAT number, and tax identification number. Finally, we collect modelling-related data such as body measurements (e.g., height, waist, etc.), eye and hair color, skills and talents, occupation, availability, and visa or travel status. 

Throughout the course of the relationship, we may also collect and store additional data, including requested and completed assignments (such as assignment details, fees, and usage rights), as well as photos and videos provided by you or by third parties. 

We may also collect, store, and use sensitive personal data such as, but not limited to, information about your race or ethnic background and health-related details, including dietary requirements (e.g., allergies) as strictly necessary to deliver LM’s services. This may also include personal documentation required for administrative purposes related to your travel and access to assignment locations. Such data will only be processed with your prior consent, and only information that is strictly necessary will be retained. 

LM collects and processes your personal data in order to provide our core services as a modeling agency, including providing guidance, training and development opportunities as well as promoting your image to clients and third parties. In this context, certain personal information such as your name, special characteristics, photographs, nationality, date of birth, eye and hair color, and body measurements may be published on our website for sales, marketing, and communication purposes, including presenting you to potential clients and partner agencies. This promotion may occur through both online channels (such as our website, social media, and email campaigns) and offline materials (such as model books and Sedcards). 

Your name, address, email, and phone number are collected to enable us to contact you regarding upcoming or completed assignments, as well as matters related to your modeling activities and management. (Company) name, company registration number/VAT number or tax identification number, personal identification number, bank account details, and payment transaction data are collected to ensure proper financial settlement with you and the relevant tax authorities. Additionally, your name and email address may be used to send newsletters and provide you with direct marketing, suggestions, and recommendations about events or services that may be of interest—provided you have given your prior consent. 

Copies of your identification documents are processed to facilitate travel arrangements, including booking transportation and accommodation, as well as to provide any necessary documentation requested by a client or third party, such as confirmation of your travel itinerary and identification. In some cases, your passport information may also be used to assist with your visa application, which may involve submitting the required documents to relevant authorities or partners to ensure you meet the specific requirements for visa approval. 

For parents or guardians of a Talent under the age of 18, we also collect and process parental or guardianship information, including the relationship to the Talent, contact details, address, and full name. This data will be processed when required for legal compliance, safety, and communication purposes. 

Our basis for processing this information is your consent to the processing of the personal data, cf. GDPR Article 6.1.a and Article 9.2.a, to carry out the responsibilities assigned to LM as specified in the agreement with you, and to contact you and/or your parent/guardian when necessary, cf. GDPR Article 6.1.b, to pay any relevant fees and comply with accounting law, cf. GDPR Article 6.1.b and Article 6.1.c, our legitimate interests, cf. GDPR Article 6.1.f., and information that has been made publicly available by you, cf. GDPR Article 9.2.e. 

3.5 Collaborating agencies/partners and/or supplier 

If you are a partner, supplier, or a contact person at a partner/supplier or collaborating agency, we process information such as your name, company name, business address, work phone number, email address, job title, and other details you provide to us as well as any publicly available information. 

We process this information for contract management, to receive goods and services from our suppliers and partners, and, where applicable, to fulfill agreements with our clients. 

Due to the purpose of the individual agreement, it is therefore a requirement that the abovementioned parties provide the personal data specified above. If the party does not wish to provide this information, the agreement may not or may only partially be finalized, and in some cases, payment may not be processed. 

Our basis for processing this information is the agreement with you, cf. GDPR Article 6.1.b, or our legitimate interests, cf. GDPR Article 6.1.f. 

3.6 Job application and job agent 

If you apply for a job at LM, we collect personal data provided by you, such as address, phone number, email, pictures, video, application, and CV in order to assess whether you match a current hiring need in our company. 

If you choose not to provide the requested information, we will be unable to consider your application for our positions, as it is necessary for us to assess your suitability for the role. 

If you sign up for our job agent, we register the data you provide, including name and email, to send you relevant job postings. 

Without providing the requested information, you won’t be able to sign up for our job agent and receive automatic notifications about job openings that match your profile. 

Our basis for processing this information is our legitimate interests, cf. GDPR Article 6.1.f. 

If you are part of a recruitment process and/or hired for the job, we will give you separate information about how we process your personal data. 

3.7 Other situations 

 
In connection with LM’s development, the company structure may change, for example, through a complete or partial sale of the business. In the event of a partial transfer of assets that include personal data, the legal basis for the associated disclosure of personal data is primarily GDPR Article 6.1.f, as LM has a legitimate interest in transferring parts of its assets and making commercial changes. 

Personal data that we have collected for the purposes described in the other points of section 3 may also be processed to comply with laws and regulations to which we are subject in connection with the operation of our business, or to fulfill various reporting or disclosure obligations under applicable laws and regulations, cf. GDPR Article 6.1.c.  

We are required to retain all accounting records in accordance with the Danish Bookkeeping Act for a period of time. This means that we store orders, invoices and similar documents for accounting purposes. These records may contain personal data such as name, address, and service description. 

For certain data processing activities in LM, there are independent specific privacy notices:

4. TRANSFER OF DATA 

In certain cases, we may share your personal data with third parties, including: 

  1. Internal Third Parties: 

Your personal data may be shared within our organization, including with our affiliated companies, departments, or employees who require access to your data for the purpose of providing our services.  

  1. External Third Parties: 

We may also disclose your personal data to external third parties, if required by law or as part of the services we provide to you. This includes authorized third-party service providers who assist in facilitating and delivering our services and need access to your personal data to contact and process transactions with you (e.g., banks and payment processors); service providers acting as processors who provide IT and system administration services such as newsletter service providers or customer satisfaction survey providers; respective authorities and/or professional advisers acting as sub-operators including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services as required. 

   

In some cases, we might transfer your personal data to third parties in countries outside the EU/EEA, where necessary.  
  
Transfer of personal data to third countries takes place within the framework of chapter 5 in the General Data Protection Regulation, meaning that such transfers will only happen:  

  • towards third countries, one or more specific sectors within a third country, or international organizations for which the European Commission deems that an adequate level of protection of personal data is in place; or  
  • if the recipient of the data obtained an appropriate certification or adhered to a specific code of conduct ensuring that the processing of personal data is appropriate and equal to those provided under EU law; or  
  • if the recipient implemented appropriate standard contractual clauses, prepared by the European Commission or prepared by the national Data Protection Agency and approved by the European Commission.  
  • in accordance with Article 49.1.b-e. 

  

5. STORAGE OF YOUR PERSONAL DATA  

We store your data for the above purposes, securely and in compliance with the provisions of the applicable laws.  

  

We limit access to your personal data to those employees and other third parties who have a strict business need to know your data.   

  

We only store your data for the duration necessary to fulfill the purposes for which it was collected or to comply with the contractual, legal, accounting or reporting obligations and observing the retention periods stated by the applicable laws.   

Accordingly, we anonymize and/or delete your personal data once it’s no longer necessary to achieve the purpose for which it was collected.  

Personal data related to newsletters and marketing is retained as long as you remain subscribed and/or as long as you are represented by LM or a client of LM. Upon unsubscribing or termination of representation or client relationship, the data will be deleted no later than two years thereafter to document the consent provided. This retention period is based on LM’s legitimate interest in being able to document that direct marketing activities have been conducted in compliance with applicable laws. 

For Talents that have been scouted or similar, we only store your data for the duration necessary to fulfill the purposes for which it was collected, meaning for the time strictly necessary for the assessment of your potential as a talent. If the procedure doesn’t end with the establishment of a relationship with you, your personal data will be deleted no later than 6 months of the decision. 

Personal data collected for the purpose of entering into an agreement regarding model representation is retained for as long as continued processing is necessary to fulfill our obligations under the agreement and as long as we are required to retain the data in compliance with applicable laws. 

Information collected in connection with the development of existing or potential client relationships is retained as long as it is relevant to the existing or potential client relationship, and for an additional period of up to six months. 

Personal data included in accounting records is retained for five years from the end of the financial year, after which the data is deleted. The retention period is established based on the retention requirements of Section 10 of the Danish Bookkeeping Act and is therefore intended to comply with applicable legislation. 

LM has implemented technical and organizational measures to safeguard the processing of personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. These measures include physical and technical safeguards such as access control, video surveillance, passwords, encryption, and regular data backups. LM’s employees are trained in handling personal data appropriately, and internal guidelines have been established to address breaches of data security. 

6. YOUR RIGHTS  

According to the General Data Protection Regulation (GDPR), and the relevant data protection law you are entitled to exercise the rights as applicable to the specific processing situation. If you wish to exercise your rights, please contact us. 

Your rights include the following: 

  • The right to request access to your personal data: You have the right to access the personal data we process about you. 
  • The right to rectify your personal data: You have the right to have incorrect personal data about you rectified and incomplete personal data completed. 
  • The right to erasure of your personal data: In certain circumstances, you have the right to have personal data about you deleted before the time we normally delete your information. 
  • The right to restriction of processing: In certain circumstances, you have the right to restrict the processing of your personal data. If you have the right to restrict processing, we may only process the data – except for storage – with your consent, or for the establishment, exercise, or defense of legal claims, or to protect a person or important public interests. 
  • The right to data portability: In certain circumstances, you have the right to receive your personal data in a structured, commonly used, and machine-readable format, and to have these personal data transferred from one data controller to another. 
  • The right to object against the processing of your personal data: In certain circumstances, you have the right to object to our processing of your personal data, and always if the processing is for direct marketing purposes.  

If the processing is based on your consent, you have the right to withdraw your consent at any time. This can be done by contacting us at the above email address. Withdrawal of your consent will not have any negative impact. However, it may mean that we can no longer fulfill specific requests from you in the future. Withdrawal of your consent will not affect the lawfulness of processing based on consent before its withdrawal. Furthermore, it will not affect any processing carried out on another legal basis. 

You have the right to file a complaint with the competent supervisory authority, which in Denmark is “The Danish Data Protection Authority” (Datatilsynet). More information can be found here: www.datatilsynet.dk  

7. LINKS TO OTHER WEBSITES AND SOCIAL MEDIA 

On our website, there are links to other websites or to integrated websites. LM is not responsible for the content of other companies’ websites or for their practices regarding the collection of personal information.  

When you visit other websites, you should always read the website’s privacy policy and other relevant policies. 

At the bottom of our website, you will find a link that directly references to LM’s profiles on the respective platforms, specifically Instagram, Facebook, LinkedIn and TikTok.  

Please be aware that when you use this link, your data, including cookies and search history, may be shared with the respective platform provider. For example, if you use the link for direct access to LM’s Instagram profile, your data will be shared with Meta, the provider of Instagram. Note that these providers are considered independent data controllers. This means that LM does not have authority over the data processed by these providers. If you have questions about how any of these providers handle your personal data as a result of using these links or similar, please refer to the provider’s privacy policy or contact the provider directly.

8. REVISION OF OUR PRIVACY NOTICE  

We keep our privacy notice under regular review and thus, the notice may be subject to changes from time to time. The date of the latest revision of the privacy notice can be found on the bottom of this page. Any new, modified, or amended privacy notice will apply as per the revision date. Therefore, we encourage you to periodically review this statement to be informed about how we are protecting your information.
